Following registration, Steenekamp & Kloppers Attorneys will assist with opening a new municipal account in
your name and provide a registration confirmation letter and draft deed to help you close your water and electricity accounts with the Council.
However, it is your responsibility to ensure that your accounts are correctly opened or closed, that you receive
monthly statements, and to follow up on any applicable refunds. If needed, we can provide contact details for consultants or companies who can assist with this process.
Conveyancing process in 10 easy steps
Step 1
Upon signature of the Deed of Sale by the Purchaser and its acceptance by the Seller, the Purchaser shall apply for a bond through a financial institution, make a cash payment, and/or provide guarantees to secure the purchase price.
Step 2
Upon bond approval, the attorneys will receive a Letter of Grant, Quotation, or Pre-Agreement, and the bond attorneys will be instructed electronically.
Step 3
Cancellation figures for the Seller’s existing bond are requested, along with clearance figures from the local municipality—at the Seller’s expense—which are valid for six months in accordance with Section 118 of the Municipal Systems Act. If the property is a sectional title, additional figures are obtained from the body corporate.
Step 4
The attorneys prepare the bond, transfer, and FICA documentation. The Seller is not required to sign the bond documents.
Step 5
The Purchaser is responsible for paying the transfer & bond costs. Transfer duty is payable to SARS upon the transfer of property from one party to another. However, if VAT is applicable, transfer duty will not be required.
Step 6
The Seller is responsible for paying rates and taxes up to the date of registration, as well as any costs associated with cancelling their existing bond, if applicable
Step 7
Steenekamp & Kloppers will then obtain the Transfer Duty Receipt from SARS, the Clearance Certificate from the local authority, or, in the case of a sectional title, the Clearance and Insurance Certificates from the Body Corporate.
Step 8
Once the transferring, bond, and cancellation attorneys are all ready, the necessary documents are lodged with the Deeds Office as a batch simultaneously.
Step 9
Occupational rent is payable to the Seller if the Purchaser takes occupation before registration. This rent is typically paid to the us, the conveyancers, who will then transfer the amount to the Seller on the date of registration. If the Seller remains in occupation after registration, occupational rent becomes payable to the Purchaser.
Step 10
Preparation and registration are completed approximately 10 to 15 working days after lodgement at the Deeds Office.
